The security guard who fatally shot an armed man in September will not be charged after a Daviess County Grand Jury returned a “no true bill” — meaning the guard was not indicted — during the November session, according to the Daviess County Sheriff’s Office.
Sheriff Brad Youngman said the case has been closed per KRS and DCSO policy.
According to DCSO, the shooting occurred after a fight broke out involving several party guests at approximately 12:30 a.m. on September 15 at the Knights of Columbus Hall in Owensboro. Security guards attempted to break up the altercation, which had spilled into the parking lot, reports say.
During the confrontation, a subject was armed with a handgun, according to DCSO. One of the security guards fired his weapon, striking the armed subject in the chest, authorities said. Life-saving efforts were made before he was transported to Owensboro Health Regional Hospital, where he was later pronounced dead.
DCSO later identified Nelson Castillo, 21, as the person fatally shot.
Reports say that a records check into the two firearms that were recovered from the scene — one that was fired during the confrontation and that belonged to the security guard, and one that was recovered from Castillo — show that neither weapon was reported stolen.
