Harvey pleads not guilty for third-degree sodomy of a minor

A recently suspended Daviess County Public Schools teacher appeared in Henderson County District Court Tuesday for an arraignment regarding charges made against him for third-degree sodomy of a minor. At the arraignment, Evan Harvey, 27, of Owensboro, pleaded not guilty to the accusations made against him by a former Henderson student.

Harvey was arrested and charged on Sept. 10 by the Henderson Police Department after a 16-year-old student filed a complaint regarding sexual activity that allegedly occurred between herself and Harvey. DCPS was made aware of the situation and immediately suspended Harvey, who was working at Tamarack Elementary School when the charges were brought against him.

The complainant told HPD that she and Harvey had been flirtatious with one another and communicated via Snapchat. The Henderson Gleaner reported that Harvey would “move wheeled cabinets in his classroom and she would perform oral sex on him behind the cabinets so that they were out of view of the camera in the room.”

The student said she performed oral sex on her teacher at least four to five times during the 2018-2019 school year, according to the Gleaner.

Harvey’s contract with Henderson’s Central Learning Academy was not renewed for the 2019-2020 school year.

At Tuesday’s arraignment, District Judge Jill Brady told Harvey he could potentially serve between one and five years in prison if convicted. Third-degree sodomy is a Class D felony in Kentucky. Harvey’s attorney, Bryce Caldwell, represented him at Tuesday’s court appearance.

Brady told Harvey that the conditions of his bond were “continuing and ongoing.”

Harvey will appear in court for a pretrial conference on Nov. 13.
