Former DCPS teacher’s sodomy case waived to grand jury

Evan Harvey’s third-degree sodomy of a minor case was waived to the Henderson County grand jury Wednesday.

Harvey, 27, of Owensboro appeared in District Court, where he was waived to the grand jury. The Grand Jury does not determine guilt or innocence, rather it will decide whether or not there is enough evidence to indict. The Grand Jury hears the evidence and decides if there is sufficient proof to bring charges against a person.

Harvey was arrested and charged on Sept. 10 by the Henderson Police Department after a 16-year-old student filed a complaint regarding sexual activity that allegedly occurred between herself and Harvey. The complaints made stem from alleged activities that occurred during the 2018-2019 school year at Henderson Central Learning Academy.

Harvey’s contract was not renewed at HCLA for the 2019-2020 school year, and he was immediately suspended from continuing to work as an educator at Daviess County Public Schools after the claims were brought to the district’s attention. Harvey was teaching at Tamarack Elementary School when the accusations were made.

If convicted, Harvey could serve between one and five years in prison for this Class D felony. Harvey will appear in court next on Nov. 26.
