Jury trial rescheduled to 2021 for DUI-related murder case

An Owensboro man charged with murder in 2017 had his jury trial postponed until Jan. 19, 2021, during a Daviess County Circuit Court hearing Friday. 

Robert K. Garner, now 20 years old, was charged in 2017 with murder for the death of a passenger — Cody Glover — and driving under the influence. His trial was scheduled to begin next week, but an official with Daviess County Circuit Court said issues related to COVID-19 caused difficulties in selecting a jury. 

According to reports, the incident occurred the morning of Sept. 3, 2017, at the intersection of U.S. 60 East and U.S. 231 North. Garner allegedly ran a red light while he was speeding and intoxicated. A drug test revealed alcohol and PCP in Garner’s system. 

Police reports from the incident said Garner’s vehicle became airborne before striking a patch of trees lining an embankment. Reports say the vehicle flipped and came to a rest overturned in a lake. 

The warrant described the passenger, Glover, as having been ejected from the vehicle and into the lake. The victim later died at Owensboro Health Regional Hospital.

Daviess County Deputy Coroner Mike Postlewaite declared Glover’s cause of death to be drowning.
