School board candidate’s charges set to be dismissed after entering diversion

A local school board candidate had a recent charge of disorderly conduct entered as a diversion Friday in Daviess County District Court. The charge made against candidate Sharon Castle will be automatically dismissed on Dec. 18 as long as no other charges are made against her during that time. 

Castle, 78, was charged with second-degree disorderly conduct on June 22 for allegedly making racial slurs against a male subject and disregarding an Owensboro Police Department officer’s request to be reasonable and lawful in handling the situation. 

The incident occurred in the 3100 block of Burlew Blvd. According to a citation from OPD, Castle first called 911 and told dispatch she needed the police while providing no other information. 

According to reports, a second call — made by the male subject — came as officers were en route to the location and he stated that Castle “was following him, making racist statements toward him.” 

According to the citation, Castle approached the officer and “loudly said, ‘I have a problem. We have a lot of drug activity here and this guy won’t tell me who he is or who he is visiting.’” 

The officer told Castle to lower her voice and said the subject was within his right to not provider her that information. According to reports, Castle said, “Yes, he does, I am the owner,” before turning away from the officer and approaching the male subject and yelling at him to identify himself. 

According to Castle, District Court Judge Nick Burlew made the right decision Friday to waive her $165 in court costs and have the case dismissed by Dec. 18 as long as no other laws were broken before then. 

If Castle’s charge is dismissed on Dec. 18, it could be completely expunged from her record by Feb. 18 as long as she continues to abide by the law and isn’t charged for another crime before then.
