Eviction moratorium in Kentucky extended through Jan. 31

Gov. Andy Beshear announced this week that he renewed a previous executive order and extended the moratorium on evictions in Kentucky through Jan. 31, 2021.

Beshear said the Center for Disease Control also extended its moratorium on evictions through that date. Beshear’s renewed order mandates that the CDC moratorium apply in Kentucky.

Beshear also announced this week the new federal COVID-19 relief bill has designated $297,000,000 for Kentucky rental assistance, in addition to separate allocations for Louisville and Lexington. These funds can be used for past due rent, future rent payments, as well as to pay utility and energy bills and prevent shutoffs.

The CDC order and the tenant declaration required by the CDC order and by the Governor’s order are available online.

A tenant who signs and submits a declaration to his or her landlord about the inability to timely pay rent cannot be evicted. The declaration is required in order to prevent an eviction.

The CDC order does not relieve anyone of the obligation to pay rent or comply with any other obligation under a tenancy, lease or similar contract. The CDC order allows landlords to charge and collect fees, penalties and interest for failure to timely pay rent, but prohibits evictions for nonpayment or late payment of such fees, penalties or interest.
