A jury found Robert Garner, now 23 years old, not guilty of murder or manslaughter in the 2017 death of Cody Glover. The jury could not come to a unanimous conclusion on the possible charge of reckless homicide, meaning prosecutors could still pursue that charge at a later date.
The jury did find Garner guilty of operating a motor vehicle while under the influence of alcohol.
Following a five-day trial, the jury deliberated for a little more than 5 hours Monday before their decision was announced just after 5 p.m.
The jury had to reach a unanimous verdict, and was given four options regarding the count about Glover’s cause of death. They ultimately agreed there was not enough evidence to prove Garner guilty of murder or manslaughter. They were hung on the third option of reckless homicide. The fourth option would have been not guilty altogether.
Defense Attorney Steven Romines said that if the prosecution wants to pursue the reckless homicide charge at a later date, “they can and we’d be ready.”
The prosecution declined to comment due to the case still being active. The court will be reconvening at a later date to discuss the facts of the case.
